Our Deed of Assignment of a Judgment Debt template is for use by a party that wants to assign the benefit of a judgment debt to another party.

How to Assign a Judgment Debt

This document is to be used where the judgment order has already been obtained from the Court, e.g. a County Court Judgment or CCJ to prove that the debt is owed and must be paid by the debtor to the creditor. If the creditor has not obtained a judgment order for the debt, then you may instead need our template for a Deed of Assignment of a Debt.

In order for the assignee of the judgment debt (i.e. the person taking over the right to be paid the debt) to enforce the court judgment, the assignee will have to make an application to the Court. Such an application is for the assignee to replace the assignor as the judgment creditor. The judgment creditor is the party that can enforce the judgment debt. Enforcement is the next step, following the award of the  judgment, if the debtor continues to fail to pay the debt. Please note that our template for the assignment only covers the assignment itself. It does not also cover the Court application.

You should take advice if you are not familiar with the process for applying to the Court to replace the original beneficiary of the judgment debt.

Using Our Deed of Assignment of a Judgment Debt Template

You can download our template in Microsoft Word format and it comes complete with full guidance notes. Once you have downloaded the template document, you simply need to edit the details to adapt it to your needs.

When editing the template, you will need to add in:

  • the name of the party who obtained the judgment debt; and
  • the date that the Court made the Judgment Order and the amount of the debt.

The template also makes provision for the situation where the creditor has obtained:

  • a Charging Order or
  • a Final Charging Order.

If the creditor has obtained these, then the deed also assigns the benefit of them to the Assignee, along with the benefit of the Judgment Debt. Where the creditor has not obtained these, you can delete the wording.
