A Disciplinary Procedure is a legal requirement
The law requires employers to have in place a written disciplinary procedure complying with sections 3(1)(b)(i) and (c), of the Employment Rights Act 1996. The disciplinary policy can be:
- included in the employment contract (or statutory statement of employment terms), or
- provided in a separate policy or staff handbook, so long as it is mentioned in the contract or statement.
